Manatee Energy LLC ("Manatee," "we," "us," or "our") provides heat pump installation, HVAC services, energy assessments, and related products and services (collectively, the "Services"). This Privacy Policy explains how we collect, use, share, and protect information when you interact with us through our website (manatee.energy), our mobile or web applications, our software platforms, in-person consultations, site assessments, installations, and any other interaction with our company.

By using our Services, requesting a quote, providing information about your property, or otherwise engaging with Manatee, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Services or provide information to us.

2. Information We Collect

We collect a broad range of information necessary to deliver, improve, and grow our Services. This includes information you provide directly, information we collect automatically, and information we receive from third parties.

2.1 Account and Contact Information

When you create an account, request a quote, schedule a consultation, or otherwise communicate with us, we may collect your name, mailing and service addresses, email address, telephone numbers, password and account credentials, billing and payment information (processed through our payment providers), preferred contact methods and times, household composition where relevant to system sizing, and any other information you choose to provide.

2.2 Property and Home Information

Because the Services involve assessing and modifying real property, we collect detailed information about the homes and buildings we evaluate or service. This includes the property address, ownership and tenancy status, year built, square footage, number of stories, floor plans, construction details, insulation and air sealing characteristics, window and door specifications and counts, existing heating, cooling, ventilation, plumbing, electrical, and water heating systems, fuel sources and utility account information, historical and projected energy consumption, utility bills and provider account details (where you authorize us to access them), photographs and videos of the interior and exterior of the property and its mechanical systems, measurements, blower door and duct leakage test results, manual J and manual S calculations, HERS ratings and related energy modeling outputs, permit and inspection records, code compliance documentation, GPS coordinates and other geospatial data, and any other property-related information collected during site visits, virtual assessments, or through third-party data sources.

2.3 Installation and Service Data

During and after installation, we collect equipment serial numbers, model and configuration data, installation photos and notes, commissioning data, warranty registration information, performance and diagnostic data from installed equipment (including data transmitted by manufacturer controllers and cloud platforms such as Daikin Skyport or Aurora), service history, and any communications related to maintenance or repair.

2.4 Financial and Incentive Information

To facilitate financing, rebates, and incentives, we may collect information necessary to process Mass Save, MassCEC, federal tax credit, and utility program applications, including income documentation where required, social security numbers or tax identification numbers where required by program rules or financing partners, Heat Loan and other financing application data, and check images and payment instrument details.

2.5 Information Collected Automatically

When you visit our website or use our applications, we automatically collect device and browser information, IP address, operating system, referring URLs, pages viewed, click and scroll behavior, search terms, session duration, and similar usage data through cookies, pixels, tags, server logs, and analytics tools.

2.6 Information From Third Parties

We may receive information about you and your property from public records, real estate and assessor databases, prior contractors, utility companies (with your authorization), financing partners, equipment manufacturers, marketing partners and lead-generation services, referral sources, and other third parties.

3. How We Use Information

We use the information we collect for the full range of business purposes necessary to operate and grow Manatee, including but not limited to:

(a) providing, scheduling, designing, quoting, installing, commissioning, servicing, and warrantying our Services; (b) creating and managing your account and processing payments; (c) communicating with you about quotes, projects, scheduling, billing, service updates, and customer support; (d) generating engineering calculations, energy models, HERS ratings, code compliance documentation, and permit applications; (e) submitting applications for rebates, incentives, and financing on your behalf and verifying eligibility; (f) developing, training, evaluating, and improving our internal software, pricing models, operational workflows, and artificial intelligence and machine learning systems, including by using aggregated and de-identified property, installation, and performance data; (g) conducting research, analytics, benchmarking, and product development; (h) marketing our Services to you, including by email, SMS, and other channels (subject to applicable law and your opt-out rights); (i) preventing fraud, enforcing our agreements, protecting our rights and the rights of others, and complying with legal obligations; (j) monitoring installed equipment performance and proactively identifying maintenance needs; and (k) any other purpose disclosed at the time of collection or otherwise permitted by law.

4. How We Share Information

We share information with third parties as necessary to operate our business. We share information in the following categories:

Service providers and subcontractors. We share information with vendors, contractors, subcontractors, and other service providers who perform services on our behalf, including installers, electricians, plumbers, HERS raters, software and hosting providers, payment processors, customer support providers, marketing and analytics providers, and professional advisors.

Equipment manufacturers and platform providers. We share installation, registration, and performance data with manufacturers such as Daikin and with the cloud platforms that support installed equipment, in order to register warranties, enable connected features, and obtain technical support.

Utility companies, program administrators, and government agencies. We share information with utilities, Mass Save, MassCEC, municipal inspectors, permitting authorities, and other governmental and quasi-governmental entities as necessary to obtain permits, secure rebates and incentives, demonstrate code compliance, and fulfill regulatory obligations.

Financing partners. We share information with lenders, loan servicers, and program administrators (including Heat Loan partners) in connection with financing applications and disbursements you request.

Business partners and referral sources. We may share information with partners that refer customers to us or that we refer customers to, in each case as reasonably necessary for the underlying relationship.

Corporate transactions. We may share information in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction involving Manatee or its affiliates, including with prospective counterparties and their advisors during diligence.

Legal and protective disclosures. We may share information when we believe in good faith that disclosure is necessary or appropriate to comply with applicable law, legal process, or governmental requests; to enforce our agreements; to investigate or prevent fraud or security issues; or to protect the rights, property, or safety of Manatee, our customers, our personnel, or others.

Aggregated and de-identified data. We may share aggregated, anonymized, or de-identified information that does not reasonably identify any individual or specific property for any purpose, including research, marketing, benchmarking, and product development.

5. We Do Not Sell Your Personal Information

Manatee does not sell your personal information for monetary consideration, and we have no plans to do so. The sharing described in Section 4 is conducted to operate our business and deliver our Services to you, not to monetize your personal information through sale.

6. Cookies and Tracking Technologies

We and our service providers use cookies, pixels, and similar technologies to operate our website, remember your preferences, analyze traffic, measure marketing performance, and personalize content. You can control cookies through your browser settings, but disabling cookies may limit functionality.

7. Data Retention

We retain information for as long as necessary to fulfill the purposes described in this Privacy Policy, to maintain records of installations and warranties for the useful life of installed equipment and beyond, to comply with our legal, tax, accounting, regulatory, and contractual obligations, to resolve disputes, and to enforce our agreements. Property, installation, and performance data may be retained indefinitely in aggregated or de-identified form.

8. Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect the information we collect. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for promptly notifying us of any suspected unauthorized access.

9. Your Choices and Rights

You may update your account information at any time by contacting us. You may opt out of marketing emails by using the unsubscribe link in any marketing message, and you may opt out of marketing text messages by replying STOP. Transactional communications related to your projects, equipment, and account are not subject to opt-out.

Depending on where you reside, you may have additional rights under applicable privacy laws, including the right to request access to, correction of, or deletion of certain personal information, and the right to opt out of certain uses. To exercise any such right, please contact us using the information below. We will respond as required by applicable law. Our Services are directed to adults and to businesses. We do not knowingly collect personal information from children under 13. If you believe we have collected such information, please contact us and we will take appropriate steps to delete it.
